Reliable Cleans Terms of Services

Please read these Terms of Service ("Terms") carefully before using the reliablecleans.com website ("Website") or booking any cleaning services ("Services") offered by Reliable Cleans ("us", "we", or "our").

Your access to and use of the Website and our Services is conditioned upon your acceptance of and compliance with these Terms. By accessing or using the Website and/or our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Website or use our Services.

Eligibility

If you are a Reliable Cleans LLC potential customer or current customer or previous customer, or just visiting our website, these terms of service applies to you.

By using our Website and Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.

Terms of Service

Nature of Services and Relationship

In accordance with the Borello standard, Reliable Cleans (the "Company") does not supervise, direct, or control the Service Provider's work. Reliable Cleans operates as a referral agency connecting customers ("Customers") with independent professional cleaners ("Service Providers"). The Company does not provide cleaning services directly. Service Providers are independent contractors, not employees, agents, or representatives of the Company. The Company's role is limited to facilitating referrals and administrative support. Customers and Service Providers acknowledge and agree that the Company does not supervise, direct, or control the manner or means by which Service Providers perform their work.
 
Fee Structure and Payment Terms

The Company charges a referral fee for its services, which is included in the total amount paid by the Customer at the time of booking. Service Providers are compensated directly by the Company upon completion of services. Customers agree to pay all fees associated with the booking, including any applicable cancellation or rescheduling fees as outlined in Section 5. The Company reserves the right to adjust its fees with prior notice to Customers.
 
Service Provider Obligations and Tax Compliance

Service Providers are responsible for obtaining and maintaining any required business licenses, permits, or certifications necessary to perform their services. Service Providers are solely responsible for reporting and paying all applicable federal, state, and local taxes, including self-employment taxes. The Company does not withhold taxes or provide benefits such as unemployment insurance, workers compensation, or disability insurance for Service Providers.

 

Frequency Discounts

 

Frequency discounts are based on consistent service. If a recurring appointment is skipped or rescheduled beyond the frequency window, the previous clean will be adjusted to the appropriate higher rate
 

Legal Status Verification

The Company verifies the legal status or authorization to work of all Service Providers before providing referral services. Service Providers must provide valid documentation upon request to confirm their eligibility to work in the United States.
 
Cancellation, Rescheduling, and Termination

Cancellation and Rescheduling by Customers:

48+ Hours Notice: No fee will be charged.

24-48 Hours Notice: A cancellation fee of $50 will apply.

Less than 24 Hours or Lock-out: The full estimated service amount will be charged.

Satisfaction Guarantee & Claims:

We want you to be thrilled with the results. If you are not satisfied with the quality of the cleaning:

  • Re-Clean Policy: You must notify us within 24 hours of the service completion. We will coordinate with the Service Provider to return and rectify the specific areas of concern at no additional cost.​

 

  • No Refunds: Because the Service Provider is paid for their labor at the time of completion, we do not offer monetary refunds. Our guarantee is limited to a "re-clean" of the disputed areas.


 
Termination of Referrals:

The relationship between the Customer and the Service Provider may only be terminated by those parties. The Company reserves the right to decline future referrals to a Service Provider or Customer at its sole discretion.
 
Non-Circumvention and Prohibition on Misrepresentation:

Non-Circumvention: Customers agree not to solicit or engage Service Providers for off-platform work during the term of this agreement and for one (1) year following the last service date.

Referral Fee: If a Customer engages a Service Provider directly for services outside the Company's platform, the Customer agrees to pay the Company a referral fee of $2,500.00.

Prohibition on Misrepresentation: The Company will not advertise or represent Service Providers as employees or agents of the Company in any promotional materials.

 
Compliance with Licensing Requirements:

The Company complies with all applicable licensing and regulatory requirements under California law, including California Health and Safety Code 1400 and 1401. Customers and Service Providers acknowledge that the Company operates as a referral agency and not as a cleaning service provider.
 

Non-Discrimination Policy:

The Company is committed to providing equal opportunities and prohibits discrimination based on race, color, religion, sex, national origin, age, disability, sexual orientation, or any other protected characteristic. This policy applies to all Customers, Service Providers, and interactions facilitated by the Company.
 
Data Privacy and Security:

Collection and Use of Data: The Company collects, uses, and stores personal information provided by Customers and Service Providers solely for the purpose of facilitating referrals and providing administrative support. The Company will not sell, share, or disclose personal information to third parties except as required by law or with the explicit consent of the individual.

Data Protection Measures: The Company implements reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, disclosure, alteration, or destruction. However, the Company cannot guarantee absolute security and disclaims liability for breaches beyond its reasonable control.

Customer and Service Provider Responsibilities: Customers and Service Providers are responsible for maintaining the confidentiality of their account credentials and for promptly notifying the Company of any unauthorized access or use of their accounts.

Legal Compliance: The Company complies with all applicable data privacy laws, including the California Consumer Privacy Act (CCPA), and provides individuals with the right to access, correct, or delete their personal information upon request.
 
Force Majeure:

The Company shall not be held liable for any failure or delay in performing its obligations under these Terms of Service due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, governmental actions, or interruptions in transportation or utilities. In the event of a force majeure, the affected party shall notify the other party as soon as reasonably possible and make reasonable efforts to resume performance.
 
Limitation of Liability:
 
The Company is not liable for any damages, injuries, or losses arising from the services provided by Service Providers. Customers agree to hold the Company harmless from any claims, disputes, or liabilities related to the performance of cleaning services.

Governing Law:

These Terms of Service are governed by and construed in accordance with the laws of the State of California. Any disputes arising under these terms shall be resolved exclusively in the courts located in San Diego County, California.
